Either way, I believe brain function begins pretty early -- a few weeks into the pregnancy. The fetus at that very early point is mentally the equivalent of a catatonic, but progresses from there. Dare I say, it's all a case of where you draw the line. Well, you could argue that identity starts when the physical distinction begins, which is pretty early, or later, when brain function begins.
