Real Tort Reform

You want real reform to get rid of frivolous lawsuits? Okay take a look at this here:

Woman struck by train sues railroad

[Patricia M. Frankhouser,] who was slightly injured after being struck by a train while walking along railroad tracks sued Norfolk Southern Corp. Thursday….

Within the filing, [her lawyer] argues that the railroad was negligent for failing to post signs warning “of the dangers of walking near train tracks and that the tracks were actively in use.”

“Defendant’s failure to warn plaintiff of the potential dangers negligently provided plaintiff with the belief she was safe in walking near the train tracks,” the suit states.

Ladies and Gents, this woman is arguing that she was unaware that trains run on train tracks. (She is also arguing that the railroad had an active responsibility to make sure she was given this vital information!) Any time somebody brings a case like this before the court, the judge should be required by law to remand the plaintiff into permanent state custody for the good of society. This woman has clearly proven herself too stupid to live free — anyone that dumb is a clear danger to herself and others.

After the nice men in the white coats take her away, her lawyer should be disbarred for taking advantage of the mentally disabled.
